Speaking at the Blockchain Association Policy Summit in Washington D.C., he emphasized the importance of not rushing a poorly constructed bill just to claim legislative success. Moreno highlighted that previous efforts, including a law regulating stablecoins passed earlier this summer, have faced significant hurdles when trying to establish a more detailed framework that clarifies the roles of regulatory bodies like the SEC and the CFTC.
The House and Senate have differing versions of the proposed legislation, with the House's Digital Asset Market Clarity Act already passed in July. The Senate, however, faces a more challenging path. Moreno, a member of the Senate Banking Committee, outlined ongoing negotiations aimed at establishing clear jurisdiction between the SEC and CFTC and introducing the term "ancillary assets" to define certain cryptocurrencies. The Senate Banking Committee is also collaborating with the Senate Agriculture Committee, which has its own draft legislation that would expand the CFTC's authority.
Upcoming deadlines add urgency to these discussions. Chair Tim Scott from the Senate Banking Committee mentioned the possibility of a markup hearing on December 17 or 18, but Senator Mark Warner warned that achieving this before the holidays might be difficult due to pending White House language on quorum and ethics. Complications remain, particularly around the regulation of decentralized finance and the differing positions on stablecoin yield, which are crucial for moving forward.
